Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using the Papap mobile application ("App") or visiting our website at papap.co ("Website"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App or Website.

These Terms apply to all users of Papap, including those who create accounts, post content, join or create events, use Roadside Assist, or simply browse the platform.

Our Privacy Policy is incorporated into these Terms by reference and explains how we handle your personal data.

2. Description of Service

Papap is a motorcycle community platform that provides:

• Group Rides & Events — tools to create, discover, and join motorcycle events with routes, waypoints, and group chat
• Moments — a social feed to share photos and stories from rides
• Roadside Assist — a peer-to-peer network where riders can offer and request help with mechanical issues, fuel, first aid, and more
• Garage — a personal space to manage your motorcycle collection

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

3. Accounts & Registration

3.1 Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to create an account. By registering, you confirm that you meet this requirement.

3.2 Account Creation

You may register using an email address and password, or via Google or Apple Sign-In. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account credentials confidential and not share them with others
• Notify us immediately at [email protected] if you suspect unauthorised access to your account
• Be responsible for all activity that occurs under your account

3.3 Username Policy

Usernames must be between 3 and 30 characters and may contain letters, numbers, underscores, and dots. You may not use a username that impersonates another person, is offensive, or infringes a trademark.

3.4 Account Deletion

You may delete your account at any time from the app's Settings. Upon deletion, your profile and content will be permanently removed from our systems within 30 days, as described in our Privacy Policy.

4. User-Generated Content

4.1 Your Content

You retain ownership of content you post on Papap, including event details, Moment photos, Garage entries, chat messages, and comments ("User Content").

4.2 Licence to Papap

By posting User Content, you grant Papap a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute your content solely for the purpose of operating and improving the platform. This licence ends when you delete your content or account.

4.3 Content Standards

You are solely responsible for your User Content. You must not post content that:

• Is unlawful, defamatory, harassing, threatening, or abusive
• Infringes the intellectual property rights of any person
• Contains nudity, graphic violence, or sexually explicit material
• Promotes dangerous, illegal, or reckless riding behaviour
• Contains spam, advertisements, or unsolicited promotions
• Includes personal data of others without their consent
• Is misleading or fraudulent

4.4 Content Moderation

We reserve the right (but are not obligated) to review, remove, or disable access to any User Content that we determine, in our sole discretion, violates these Terms or is otherwise harmful to the community.

5. Acceptable Use

When using Papap, you agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law
• Impersonate any person or entity, or misrepresent your affiliation with any person
• Attempt to gain unauthorised access to any part of the platform or other users' accounts
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated tools (bots, scrapers, crawlers) to access or collect data from the platform
• Interfere with or disrupt the integrity or performance of the platform or its infrastructure
• Upload or transmit viruses or any malicious code
• Harass, bully, or intimidate other users
• Use location features to stalk, surveil, or harm other users
• Create multiple accounts to evade a ban or suspension

Violation of these rules may result in immediate account suspension or termination without notice.

6. Roadside Assist — Important Disclaimer

By using Roadside Assist — whether as someone requesting help or offering it — you acknowledge and agree that:

• Papap does not guarantee the availability, quality, safety, or reliability of any assistance offered
• In a life-threatening emergency, you must contact the official emergency services (e.g. 112 / 911) first
• Any assistance is provided voluntarily between community members; Papap is not a party to that interaction
• You assume all risk associated with requesting or providing Roadside Assist
• Papap is not liable for any injury, damage, loss, or harm arising from interactions facilitated through this feature

Your phone number is required to create a Roadside Assist profile and will be visible to other users in the app. You may delete your Roadside Assist profile at any time.

7. Events & Group Rides

Event organisers are solely responsible for planning, organising, and running their events. Papap provides tools to facilitate coordination but does not participate in or supervise events.

• You participate in any group ride or event entirely at your own risk
• Organisers must comply with all applicable traffic laws and regulations in the jurisdiction where the event takes place
• Papap is not responsible for accidents, injuries, property damage, or losses arising from events organised or attended via the platform
• Organisers must not use events to conduct illegal activities or coordinate dangerous riding behaviour

7.1 Paid Events

Organisers may create events that require a participation fee. By using this feature, both organisers and participants agree to the following:

• Papap does not process or collect any fees. All payments for paid events are made directly between the participant and the event organiser, outside of the Papap platform, using payment methods agreed upon between the parties.
• Papap charges no commission, transaction fee, or service fee on any paid event.
• Papap is not a party to any payment transaction and accepts no responsibility for disputes, refunds, chargebacks, or financial losses arising from paid event arrangements.
• Organisers are solely responsible for any applicable taxes, refund obligations, or legal requirements related to collecting fees from participants.
• Participants should verify the legitimacy of an event before making any payment. Papap does not verify, guarantee, or insure any paid event.

8. Intellectual Property

8.1 Papap's Property

The Papap name, logo, App design, and all original content created by us are owned by or licensed to Papap and protected by intellectual property laws. You may not use, copy, or distribute any of our intellectual property without our prior written consent.

8.2 Feedback

If you submit feedback, suggestions, or ideas about the platform, you grant us an unrestricted, irrevocable, royalty-free licence to use them for any purpose without obligation or compensation to you.

9. Third-Party Services

Papap integrates third-party services including Google Sign-In, Apple Sign-In, Mapbox, Firebase (Crashlytics and Cloud Messaging), and Cloudflare R2. Your use of those services is also governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

The App may contain links to external websites or services. We do not endorse and are not responsible for the content, privacy practices, or availability of those external resources.

10. Disclaimers

Papap is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose
• Uninterrupted, error-free, or secure operation
• Accuracy or reliability of content posted by users
• Availability or quality of Roadside Assist help

We do not warrant that the App will be compatible with your device, or that defects will be corrected. Use of the App while riding a motorcycle is dangerous and strictly your own responsibility. Always prioritise road safety.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Papap and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of data or content
• Personal injury or property damage resulting from events, rides, or Roadside Assist interactions
• Losses arising from reliance on user-generated content
• Service interruptions or App unavailability

Our total liability to you for any claim arising from or related to these Terms or your use of the platform shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain liabilities — in those cases, our liability is limited to the extent permitted by law.

12. Account Suspension & Termination

We reserve the right to suspend or permanently terminate your account, with or without notice, if we believe you have:

• Violated these Terms or our community standards
• Engaged in fraudulent, abusive, or harmful behaviour
• Repeatedly posted content that violates Section 4
• Used the platform in a way that may expose Papap or its users to legal liability

You may appeal a suspension by contacting us at [email protected]. We will review appeals at our discretion but are not obligated to reinstate any account.

Upon termination, your right to use the platform ceases immediately. Sections 4.2, 8, 10, 11, and 14 of these Terms survive termination.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the App or by email at least 14 days before the changes take effect. The "last updated" date at the top reflects the most recent revision.

Continued use of Papap after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the platform and may delete your account.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or your use of Papap shall be subject to the exclusive jurisdiction of the competent courts in the country where Papap operates.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
